Gun Control Coming to the Senate Floor on Monday

The U.S. House of Representatives did a very dangerous thing Tuesday — and, apparently, it did so with the consent of one gun organization.

By voice vote, the House slammed through a ten-year reauthorization of the poorly drafted 1988 plastic gun ban.

Lest anyone be confused about how the anti-gun Left views this, USA Today crowed, on the front page of Wednesday’s newspaper that the “HOUSE SAYS YES TO ONE GUN BILL — Plastic gun ban only firearm legislation to pass since November.”

Taken alone, this gives the Obama administration, if it chooses, another three years to use the 1988 law to ban large numbers of guns.

But there is an even bigger danger:  Chuck Schumer held a press conference the same day to indicate that he will use the House-passed bill as a vehicle to pass even more gun control.  We don’t expect to know Schumer’s bill number or language before he actually offers it, but it will purport to deal with guns from 3-D printers, while actually being much broader.

So here’s what we are doing: We are asking our friends in the Senate to put a “hold” on any effort by Schumer to amend the House bill.

The Senate will only be in session four or five days next week before the House goes out for the year, and Schumer may not be able to get time on the Senate floor without “unanimous consent” from all senators.

So, by doing this, we would force Schumer to give up on his vehicle for banning printer-guns if he wanted any reauthorization of the 1988 bill.  If Schumer remains adamant, there will be no reauthorization at all.  Even if he capitulates, we’ll see what happens.

It’s not a perfect outcome.  But we think it’s an outcome we can probably achieve.

Urgent alert:  Gun vote could come as soon as Monday in the House

With 80,000,000 Americans poised to lose their employer-provided insurance plans, what would you think the Senate’s number three Democrat, Chuck Schumer, is now poised to cram down Republicans’ quivering throats?

ANSWER:  More gun control.

Senator Schumer already tried to sneak a gun control bill through the Senate on November 21 — right before Thanksgiving — and according to one congressman, the House could use a parliamentary procedure to pass it as early as today (Monday).

But let’s take a step back to explain.

Earlier this year, Schumer threatened that, if he did not get his way — destroying the “gun manufacturers’ lobby” in the process — your children would be killed.  We actually received anonymous faxes and e-mails from Schumer’s allies, telling us that our children should have been killed at Newtown.

Now Schumer is threatening that, if he cannot pass gun control, your plane will be hijacked.  Schumer’s new threat is similarly odious and baseless.

At issue is the reauthorization of the 1988 Plastic Gun Ban.

Crammed through in 1988 by a newly Democratic Senate looking for guns to ban, it was passed at a time when there was no actual problem.

Having said that, the poorly drafted law has always been an anti-gun time bomb, waiting to explode in the hands of an anti-gun president — which we now have.

If, after removing grips, stocks, and magazines, any gun is not as “detectable” by a metal detector as is a “Security Exemplar,” the gun is banned — permanently.

Within certain broad parameters concerning metallic standards, anti-gun Attorney General Eric Holder gets to determine the exact shape and characteristics of the Exemplar, what metal detector is used, and how many times (or how many thousands of times) the gun has to pass.

Also, if any major component of the gun — which the statute tries to define, but may ultimately be defined by Holder — doesn’t produce an accurate x-ray image (again, defined by Holder), the gun is banned.

All of this would be just a theoretical problem if we didn’t have a president and an Attorney General who were willing to go to any length — including actually violating the law — in order to destroy the Second Amendment.

So where are we now?  And why should Congress think long and hard about giving into the demands of a ruthless partisan who is denying votes on the things Americans desperately care about?

FIRST, Schumer and his allies have engaged in a concerted effort to use a plastic gun ban reauthorization to ban much of America’s firearms manufacturing. Drafts which they have pushed all year would ban a printer, mold, or program which could conceivably be used to make a plastic gun.  The problem is that any such printer, mold, or program would also ban technology and molds used by many firearms manufacturers to make widely used metal guns. As with gun control proposals earlier this year, Schumer is trying to use hysterics to pass proposals inimical to the Second Amendment. He should not be allowed to do so.

What this means is that the Undetectable Firearms Act, which was passed in 1988 in response to no particular threat — and has been useless during its 25 years of existence — is now being used as a platform for calling for more gun control.

SECOND, it is simply not true that, failing reauthorization, killers could “carry plastic guns into schools, courthouses, and airplanes.” All of these are illegal [18 U.S.C. 922(q) and 930], and will remain illegal. Further, reauthorization is not going to make it practically more difficult to get a plastic gun, as the program is already out there, and the genie is effectively out of the bottle. Why would an Adam Lanza, going into a public venue to engage in mass shootings, decide that a plastic gun ban was the one law he had to obey?

THIRD, Republicans need to begin punishing Reid and Schumer for last month’s “nuclear option” — which effectively destroyed the Senate as an institution. Republicans have talked about retaliation, so would they give in to the first anti-gun demand Schumer makes?

FOURTH, Schumer attempted to slam through his gun manufacturing ban without a vote (i.e., by unanimous consent) and without notifying Republicans of his intentions through a telephone notification procedure called “hot-lining.”  As of the end of November — more than a week after Schumer tried to pass the gun ban — we still didn’t have the language of the bill Schumer tried to pass the previous week by unanimous consent. Have we learned nothing from ObamaCare? If slime and corruption are rewarded, there will be even more of it.

FIFTH, Schumer wants to ban guns.  Okay, we all understand that.  But the GOP also has a “wish list” which has been stifled — and denied a vote — by the dictatorial tactics of Harry Reid and Chuck Schumer. For instance, Senate Republicans have pushed to restore the constitutional rights of more than 150,000 veterans who were stripped of all due process and had their guns taken away. Republicans want to postpone or repeal the individual mandate on the anti-gun ObamaCare program, which everyone now realizes was passed on the basis of a pile of lies, and which now threatens to strip 80,000,000 Americans of their employer-provided policies. Republicans want the gun reciprocity bill, supported by a bipartisan majority of the Senate, despite Harry Reid’s efforts to bury it. Are any of these less important than Schumer’s slobbering demands for more gun control? If not, why should Schumer’s bill move without one or more of these amendments added to it?

SIXTH, with only about seven legislative days left in the first session, it’s a little late to be diving into the thorny subject of regulating printers and the Internet.

So please, let’s not let congressional Republicans give Schumer the satisfaction of passing gun control — and “bashing the gun lobby.”  Ultimately, victory feeds on itself. And defeat feeds on itself. And, if Republicans gratuitously give the anti-gun Far Left a victory without firing a shot, they will have only succeeded in bringing to life a gun control movement which has, as a chief objective, the destruction of the Republican Party.

“One thing that’s not being reported about this whole immigration thing is the degree to which it’s opposed by the people in this country,” said Rush Limbaugh.  “You try calling, you can’t get through [because] you are inundating them.  You are overwhelming them.”

The U.S. Senate passed the anti-gun amnesty bill today on a 68-32 vote.

Through this long, hard fight, you guys tied up the Capitol Hill phone lines in opposition to the bill.  And your voice has resonated, much to the chagrin of the anti-gun politicos on Capitol Hill.

At first blush, the final tally might seem like an overwhelming loss for our side, but the fact is, it represents the proverbial “kiss of death” for Chuck Schumer’s anti-gun, amnesty forces.

Senator Schumer & Co. fell far short of the goal they set for passing the amnesty bill — a goal they HAD TO ACHIEVE if they were going to have ANY momentum at all in the House.

Chuck Todd, a perennial water-carrier for the Obama administration, lamented this on MSNBC this week:

“The sweet spot was 75-plus in the Senate because that number would have meant that they would have gotten half of the Republican conference [and would put pressure on House Republicans].  Instead, it looks like they are not going to get that.”

Several times, Senator Schumer tried to achieve his “sweet spot” of 70-75 votes -– which would have allowed him to claim that his bill had momentum going into the House.

But several times, Schumer failed.  And on the final vote, he fell almost ten votes short of what he needed.

This is just the beginning of the bad news in store for Schumer.  Now that his bill goes over to the House, we have a really nasty surprise for him.

It’s called a “blue slip,” and Congressman Steve Stockman (R-TX) is pushing the House leadership to pass a blue slip resolution that would send the Senate amnesty bill into the trash heap because it raises taxes — an initiative that, under the Constitution, must begin in the House of Representatives.

This is not the only problem the Senate bill has.  In addition to the blue slip problem, both liberal and conservative media are declaring the bill is “Dead on Arrival” in the House for various reasons:

* We have revived the “Hastert Rule,” and Boehner is now saying that he won’t bring up the Senate-passed immigration bill for a vote.

* Rep. Tom Cole (R-OK) was quoted in The Washington Post yesterday as saying that the House won’t seriously debate any immigration reform until mid-Fall.

* And in the Senate, we will filibuster any effort to stick it onto a new House-initiated vehicle.

Trust us that the media would have used a 70-80 vote margin to try to create the impression of massive bipartisan momentum. They can’t do that easily now.

Now that the Senate has finished its consideration of the amnesty bill, the battle moves to the House — probably in a few months.  So now’s a good time for everyone to send a parting, closing shot to their Senators.

ACTION:  Contact your Senators Please thank those Senators who voted against the anti-gun amnesty bill and reprimand those who voted for it.

Sell-out amendment falls three votes short of Schumer’s goal of 70
Sometimes victory is relative.  But that doesn’t make it any less definitive.

Today, beginning at 5:30 pm (EST), only 67 Senators — three short of Chuck Schumer’s 70-vote target — voted to shut off debate on the anti-gun Hoeven-Corker-Leahy amnesty amendment. It is noteworthy that only 15 Republicans voted for cloture (to end debate), while an overwhelming majority of GOP Senators voted against it (that is, most Republicans wanted to keep the filibuster in place).

The Chuck Schumers of the world did everything in their power to get the 70-vote threshold which they had predicted — and which became a floor for the number of votes necessary in order for anti-gunners to avoid embarrassment.

They gave Nevada Senators an unending open-ended sky’s-the-limit program to tout tourism in Las Vegas.

They gave Vermont Socialist Senator Bernie Sanders $1.5 billion in social spending in order to buy his vote.

And so it went.  One Senator after another after another secured irrelevant buy-out amendments as the price for selling out. It was ObamaCare 2.0.

But that wasn’t enough.

By falling short of their 70-vote goal, Schumer & Co. in effect admitted that the bill would limp out of the Senate without any momentum going into the House.  Coupled with our successful efforts to revitalize the Hastert Rule in the House, anti-gun immigration reform is on track to being dead for the year because House Speaker Boehner has said he will not pass it with largely Democratic support.

Does that mean we can declare victory and go home?  No.  As usual, you don’t pop the cork until they bang the gavel. You keep fighting.
And to that end, gun owners should express their dissatisfaction with Senators who voted for the amendment.  You can go here to see how your Senators voted.
As sweet as the 67-27 vote was, it means that our job is not over.

Schumer was unable to break through his 70-vote target because he was so intent upon slamming this bill down our throats that he scheduled his vote when many of his supporters could not make it. If we REALLY want to continue raining on Schumer’s parade, we’re going to have to repeat our achievement on Wednesday, when the Senate votes on cloture on the substitute which contains the sell-out provisions — and on cloture on the whole bill itself.

This means we need to flip a couple of votes, and Senators Orrin Hatch (R-UT) and Roger Wicker (R-MS) — both of whom both voted for the sell-out — are the most obvious potential pick-ups.

Turning America “blue” could lead to California-style gun control

“Immigration reform could be a bonanza for Democrats [and] cripple Republican prospects in many states they now win easily.” — Politico, April 22, 2013

In 1984, California was sufficiently conservative so that it cast its electoral votes for President Ronald Reagan. It was not fiercely pro-gun, but, then again, it wasn’t New York.

But, in 1986, Reagan signed an immigration amnesty bill, called Simpson-Mazzoli. The bill was small compared to the current amnesty bill. Three million illegals benefited.

But that was enough to change California from a sometimes “swing state” to a state almost wholly controlled by Leftists. Within 20 years — and continuing to this day — California couldn’t pass enough gun bans, gun registration, ammunition limits, and ammunition registration.

So it is with some concern that Chuck Schumer’s amnesty bill (S. 744) which is currently on the table would cover 11,000,000 to 20,000,000 illegal aliens — four to seven times the size of the Simpson-Mazzoli bill.

We predict that, if the bill is passed, by 2035, the American electorate will have changed so fundamentally that California-style gun control could become a very real possibility in this country!

We know you’re tired. We have just fought a hard-fought battle over explicit gun control in the Senate — a battle which we won.

But it does strike us as interesting that the same gun control crazies who pushed gun control want to slam immigration amnesty through the Senate quickly so they can redirect their fire against us again.

Who are the chief architects of forging a more anti-gun electorate? Well, the chief sponsor of S. 744 is Chuck Schumer, and he is joined by other Second Amendment haters such as Dick Durbin (D-IL), Bob Menendez (D-NJ) and compromiser John McCain (R-AZ).

Over the next week or so, we’ll let you in on some of the anti-gun specifics of Schumer’s “amnesty bill,” as it’s correctly dubbed. But for starters, the bill would push us towards a biometric ID card, which is something that GOA has opposed for years — given that a de facto National ID poses a huge threat to gun owners’ privacy.

But then there’s the fact that Schumer’s “amnesty bill” requires the government to give its okay — in a Brady Gun Check-type procedure — before you could get a private job in America (section 3(c)(2)(A)(iii)). Does anyone not see why this might be a problem?

We’ve just gone through excruciating pain to stop the expansion of Brady Checks for guns. Now we turn around and the same parties who were pushing that are now pushing Brady Checks for private jobs.

It’s ironic that those pushing for background checks are adamantly against ID’s for voting because that would disenfranchise the elderly, the poor, and minorities. Hmm, so they do understand that background checks  as a prior restraint — are a fundamentally flawed concept?

But this is where the real fun starts. You feed the potential employee’s info into a government database and, according to Senator Durbin, “up pops a picture.” And, says Durbin, “if that picture doesn’t match [the one on your ID], you may not be employed.”

The Brady Check deals with a list of names which is in the millions. It deals only with things like names and social security numbers, not pictures. Yet it gives “false negatives” 8% of the time. And if you’re one of those 8% who are illegally denied a gun, the FBI’s response, more often than not, is “So sue us.” If this weren’t bad enough, the system breaks down for days at a time — normally the times when the most people need it.

Do we really want to expand this flawed concept to other areas of our lives?

If this weren’t bad enough, we know that, once the government has to give its approval before you can do something, it’s an almost iron-clad guarantee that it will exercise that power in a political manner. Under the Brady Check system, 165,000 law-abiding honorable veterans have lost their gun rights, not because they have done anything wrong, but because they sought counseling from the VA on the basis of a traumatic experience in the military.

Watching Schumer explain on the Senate floor why those veterans should lose their constitutional rights without any court order — while he vigilantly defends due process for foreign terrorists — is like watching a dung beetle drag its “prey” back to its lair.

So we know 165,000 non-politically correct veterans lost their gun rights under Brady Checks. Who will become politically incorrect unemployable non-persons under Brady Checks for Jobs?

Now, one would think that the fact that one million people in Boston were put under house arrest last week because our current immigration system allowed two asylum-seekers from terrorist-filled Chechnya to become legal residents and, in one case, a citizen of our country, will put the skids on the “inevitability” of Schumer’s amnesty bill. After all, gun control was “inevitable” too.

But the bottom line is this: Just as we saw the gun ramifications of ObamaCare, we will also see the problems with a bill that alters the electorate in such a way that the Second Amendment will cease to exist. In doing so, we will need to make sure that we don’t have most of our guns registered or confiscated in 2035 because short-sighted politicians listened to MSNBC and turned our country blue.

But we will also make sure that we do not take bad gun law and turn it into bad employment law.

Urgent action required. It is urgent that every gun owner call their Senators today and demand that they oppose the “See a Shrink, Lose your Guns” sell-out bill that is being authored by Senators Pat Toomey (R) and Joe Manchin (D) – but which also has Chuck Schumer’s fingerprints all over it. Call immediately at 202-224-3121.

See a Shrink, Lose your Guns. The anti-gun “ranters” have spent the last week telling us that Republican Senators can’t filibuster Harry Reid’s gun control bill; that they can’t cut off debate to a bill they haven’t seen yet. “Let the bill come up,” they say. “We need to see the bill” before Senators can vote against cloture to proceed to it.

Well, we’ve seen the Toomey-Manchin-Schumer sell-out, and it’s worse than the Feinstein gun ban, which will reportedly be tied to it and offered simultaneously in a Senate procedure known as an “amendment tree.”

Toomey and Manchin will claim that their bill only covers “gun show sales” and Internet sales. But if you’ve ever talked about your gun and /or let it be known you’d like to sell or buy a gun on the Internet, this language covers you. If you advertise your gun in the church bulletin and the bulletin is put on the Internet, you’re covered.

The only exemption is for sales that are sold exclusively by word of mouth. The increased number of background checks would likely exacerbate the system breakdowns (inherent to NICS) which have shut down gun shows over and over again. It would mean that Americans who were illegally denied firearms because their names were similar to other people’s would effectively be barred from owning a gun. (We would never tolerate such delays for voting rights or other freedoms that we are guaranteed.)

And for those Republicans who think they’re going to be able to offer their useless amendments, guess what? Reid is reportedly going to use a procedure to block out all amendments (called an “amendment tree”). And there are plenty of Senators standing in line to make sure that the Senate doesn’t give “unanimous consent” to let those Republicans offer their amendments.

So if you live in a rural area, you’re effectively barred from selling or buying a gun – or it at least becomes very, very difficult.

Incidentally, the Toomey-Manchin-Schumer “national registry” language is full of holes. There will be a national gun registry as a result of this sell-out.

But that’s not the worst part. Under an amendment in the bill to HIPAA (Health Insurance Portability and Accountability Act), you could have your guns taken away because your private shrink thinks you’re “dangerous” and could send your name directly to the FBI Instant Check system.

Did you think it was terrible that 150,000 military veterans had been added into the NICS system because they’d seen a VA shrink about their PTSD? Well guess what? Now it’s going to happen to the rest of the population … by the millions!

And the next step, of course, will be to begin to sue psychiatrists that don’t send every single patient’s name to the Instant Check system, and to make sure that their lives are ruined if they don’t send a patient to NICS and anything goes wrong.

The bottom line: “See a shrink; lose your guns.”

All of this will reportedly be on an amendment tree with the Feinstein gun ban and magazine bans.

Repeal of gun owner protections. In addition, Toomey no doubt unintentionally agreed to repeal one of the most important protections for gun owners that was included in the 1986 McClure-Volkmer Act – the provision that would allow you to take an unloaded, locked-up gun through states like New York without being stopped. Under a new subsection (c), the Toomey-Manchin-Schumer bill would require you to “demonstrate” to the satisfaction of New York police where you were coming from and where you are going to. And, if you don’t do that to their satisfaction, they can arrest you.

Please keep in mind, nothing in this bill would have stopped Newtown dirtbag from killing his mother and taking the firearms that she owned and perpetrating the horrible crimes that he committed.

Nothing is this bill would actually make children safer at schools. There is nothing that will actually keep bad guys from stealing or illegally acquiring guns, but there’s plenty that will threaten our gun rights!

Gun Owners of America, with its war chest, membership and lobbying strength dwarfed by the National Rifle Association, is emerging as an influential force as a series of gun control measures heads to the Senate floor.” – New York Times, April 4, 2013

The Senate was supposed to be taking up gun control next week. But now it looks like the outpouring of grassroots opposition from GOA activists has forced Harry Reid to push back his plans for at least a week.

Said the New York Times, “The group [GOA] has already been successful in both freezing senators, particularly Republicans, who have appeared to be on the fence about supporting bills to expand background checks and [has been] empowering those who have a strong gun rights background.”

The article cited GOA’s work in bolstering the resolve of several Senators, but especially that of Tom Coburn of Oklahoma who has been frequently wooed by anti-gun Senator Chuck Schumer.

To date, no compromise has been reached. And that means Senate Majority Leader Harry Reid just doesn’t have the votes yet.

Here’s why:

More Senators have committed to support the Paul-Cruz-Lee filibuster, including James Inhofe (R-OK) and Marco Rubio (R-FL). There are even more Senators who are joining this list, and we will share those names with you next week.
A plurality of Senators voted for a GOA-supported Lee amendment, two weeks ago, requiring a super-majority vote to pass gun control. While the amendment failed (as it needed support from 60% of the Senate), it nevertheless sent a “shot across the bow” of the gun controllers ship.
On March 23, a majority of Senators voted to bar the Obama Administration from signing onto an anti-UN treaty. This was an important development, seeing as that the United Nations General Assembly approved the Arms Trade Treaty earlier this week.
More Congressman are joining the fight in the House to put pressure on House Speaker John Boehner to support the Hastert Rule – a rule that would kill all gun control. The number of Congressmen supporting the Stockman-Broun letter is now up to 30.

GOA has still been lobbying the House, even while we’ve been asking you to mostly focus your efforts on the Senate. To that end, MSNBC’s Andrea Mitchell asked Rep. Peter King yesterday about the influence GOA is having in the House.

“The New York Times has a report on the Gun Owners of America,” Andrea Mitchell asked. “What are members saying about the impact of lobbying groups such as them [GOA]?”

King, who is, ironically, F-rated with GOA, said that, “Larry Pratt with the Gun Owners of America is effective. I don’t deal with them myself, but the fact is, they are effective.”

As we noted above, the New York Times quoted Senate aides on Tuesday as saying that “gun issues would probably slip to the week of April 15 – a setback considering that Senator Harry Reid of Nevada, the majority leaders, had pledged that it would be the first issue to come up when Congress returns from spring recess next week.”
