GOA Activists Help Rand Paul Put Harry Reid on the Defensive!

If there is any doubt about the hatred that Harry Reid and the Senate Democrats hold for the Second Amendment, that hatred was made apparent last week.

To review the bidding: The Senate was slated, last week, to consider amendments to the giant appropriations bill funding the Justice and Commerce Departments.

Senator Rand Paul (R-KY) had submitted an amendment to prohibit Attorney General Eric Holder from continuing Operation Choke Point — a program designed to shut down gun stores by forcing banks to dry up their credit and to stop processing their credit card purchases.

You will remember that Gun Owners of America alerted you to the Paul amendment and urged you to take action in support of it.  And, wow, did your efforts make an impact!

GOA is very grateful to the thousands upon thousands of you who took action on that alert, urging Senators to support the Operation Choke Point amendment.

It got Harry Reid’s attention!

Faced with a tough vote for Democrats running for reelection in pro-gun states, Reid just pulled the bill from the floor. This means that the appropriations process will probably grind to a halt, and the government will, once again, be funded by a gigantic “continuing resolution” passed in September.

And, once again, the slimy Reid will blame Senate Republicans for his own actions in pulling the bill.

At this point, we are encouraging Senator Paul to add his Operation Choke Point defunder to every bill that comes to the Senate floor. If Democrats are unwilling to let Senators vote on the anti-gun actions of the lawless Obama administration, then Reid should not be able to pepper the floor with a succession of reelection ploys between now and November.

ACTIONContact your Senators and insist that they support Paul’s amendment to shut down Operation Choke Point.

No one hates guns more than California.

They came close to banning most semi-autos and do register all guns.  They have moved to regulate ammunition.  They have just established a $24 million program to send SWAT teams to people’s homes to confiscate their guns.  They are using microstamping and pushing gun-insurance requirements as a mechanism for banning guns nationwide.

And yet, on Friday night, California’s hatred of freedom did nothing but turn 19 people — six dead and 13 wounded — into sitting ducks, as a deranged killer went on a rampage in a quiet college town.

We, along with all Americans, pray that God will give comfort to those who mourn for the family members they lost over the weekend.

But what can we learn from this latest horrific tragedy?

First, gun control made people less safe. California, which has the strictest gun laws in the nation, has a gun-homicide rate that is 70 times higher than Utah’s — the state the Brady Campaign listed as having the least gun control in the nation.  So people are actually much safer in Utah, where guns are more easily available!

Second, the shooter (whose name we will not publicize) amply demonstrated one of his motives with his widely televised videotape and his 140-page manifesto:  he wanted to get his 15 weeks of fame on MSNBC and CNN, who immediately responded with the type of crazed coverage that can only encourage more copycat shootings.

Third, we would note that this privileged kid had been prescribed drugs such as Risperidone — and we would be willing to bet that he was one of 1-in-5 boys (and 11% of all kids, 4-17) who, because of federal law, had been shuttled onto Ritalin or Adderall. All of this tends to reinforce the apparent link between certain prescription drugs and mass murder.

What are the practical ramifications?

Well, it didn’t take any time at all for the Bloomberg vultures to descend upon the horrific tragedy to try to pick its bones for political gain.

Senator Richard Blumenthal (D-CT) and Rep. Peter King (R-NY) have already called for stricter gun controls in the wake of the California shooting.  CNN did its part to push for gun control yesterday, with a headline blaring:  “Will California shooting revive gun debate?”

And on Monday, MSNBC’s Richard Lui asked Bloomberg minion Erika Soto Lamb:  “Does this help your cause?” and “Will this emotion translate” into a greater push for gun control?  Lamb’s reply:  “Absolutely.”

What an unspeakably vile admission it is for gun control advocates to rejoice over the deaths of children because it “helps [their] cause.”

But the problem is this:  There are at least 15 Democrats running for the Senate in pro-gun states on the lie that they care something about the Second Amendment.  Some are no-name challengers.

But at least eleven are currently members of the Senate:  Mark Begich (D-AK), Mark Pryor (D-AR), Mary Landrieu (D-LA), Kay Hagan (D-NC), John Walsh (D-MT), Mark Warner (D-VA), Jeanne Shaheen (D-NH), Mark Udall (D-CO), Tom Udall (D-NM), Jeff Merkley (D-OR) and Al Franken (D-MN).

If they are allowed to go into the election without taking an actual position on gun control — one that makes a difference — and, if they are elected to the Senate, the Second Amendment will be in grave danger in 2015.

For this reason, we are asking Senators Ted Cruz and Rand Paul to force a Senate vote on changing the Senate rules to prohibit any gun control.  Harry Reid has already blown up the Senate rules to pack the circuit courts with anti-gun judges. And, Reid has further threatened to weaken the filibuster rules — a parliamentary tool which gun rights supporters have used to protect the Second Amendment.

Gun owners must encourage the pro-gun leaders in the Senate to demonstrate that they care as much about the Second Amendment as Reid cares about destroying it.

ACTION:  (1) Write your Senators.  Demand that they support Senate rules changes to prohibit any gun control from being adopted in the Senate. NOTE:  If you live in Texas or Kentucky, the Engage action site will invite you to send a different message to each of your two Senators. (2) If you live outside of Texas or Kentucky, then use the pre-written letter below to contact Senators Cruz and Paul.  (You can use the following contact information for Ted Cruz and Rand Paul).  Ask them to push a rules change to prohibit any gun control measure from passing in the Senate.

At GOA’s request, Senator Rand Paul (R-KY) has bypassed Harry Reid’s stranglehold on the Senate by bringing a pro-gun bill directly onto the Senate calendar.

The bill is H.R. 4118, and it was approved by the House of Representatives on Wednesday by a 250-160 vote.  (See the vote here, with “Yea” being the pro-gun vote.)  The bill would suspend the individual mandate of the anti-gun ObamaCare program for one year, thus protecting the privacy of gun owners.

Normally, bills that pass out of one chamber are referred to a committee in the other chamber.  But Senator Paul intervened by using a parliamentary technique to bring H.R. 4118 onto the calendar, rather than letting it be referred to a Senate committee.

Now that H.R. 4118 is “on the calendar,” this means that ANY SENATOR can now “move to proceed” to the bill, thereby CIRCUMVENTING HARRY REID’S STRANGLEHOLD over the Senate agenda.

This is huge.

It is important to gun owners because ObamaCare lays the groundwork for taking millions of Americans — those taking anxiety medications or who have PTSD or ADHD — and feeding their names into NICS’s gun-ban database.

It is important because, already, Obama, by executive fiat, has waived federal privacy laws to clear the way for these gun bans.

It is important because it forces weak-kneed senators running for reelection — senators who claim they want to “fix” ObamaCare — to vote, up or down, on whether to let 30,000,000 Americans facing hundreds of dollars of penalties off the hook.

It is important because it opens the door for “motions to proceed” to other pro-gun bills, including legislation restoring veterans’ rights and creating national reciprocity for concealed carry rights (both of which have close to 60 votes).

It is important because it allows us to compile a target list of vulnerable senators who claim they want to “fix” ObamaCare — just as Nancy Pelosi is trying to use a “discharge petition” in the House on the anti-gun amnesty bill to create a target list of GOP members.

Now, we are asking Rand Paul and other senators to begin circulating a letter of support in the Senate for a “motion to proceed” to the ObamaCare suspension, H.R. 4118.

There are procedural niceties to forcing consideration of the motion to proceed, but our parliamentary experts are working with senators to show them how to accomplish this — and to get this bill sent to the President.

Well, you might ask, isn’t Obama just going to veto H.R. 4118?  GOA’s Legislative Counsel Michael Hammond discusses the answer to this question in a recent Red State piece.

But the answer is that sending H.R. 4118 to Obama would put him in a real bind.  We believe that Obama will eventually be forced to delay the mandate, and that H.R. 4118 will create an inextricable conundrum for him — as it will give credit to Rand Paul (and other pro-gunners) in the Congress for having forced the issue.

ACTION:  Call or  Click here to write your senators.  Ask them to support the motion to proceed to H.R. 4118, which will suspend ObamaCare’s individual mandate for one year.

Stop Reid & Feinstein’s Palace Coup To Overthrow The Constitution and Bill of Rights

Stop Reid & Feinstein’s Palace Coup To Overthrow
The Constitution and Bill of Rights

DON’T BE FOOLED Feinstein’s Gun Ban S. 150 is not DEAD.
It was stopped at the front door, but the back door is WIDE OPEN.
FAX Congress to BLOCK ALL Gun-Control and Gun-Registration Legislation

Notice in the video how Senator Feinstein takes issue with Senator Cruz when he refers to her “ban” of certain weapons. Even though she titles her bill the “Assault Weapons Ban of 2013,” she insists it doesn’t really “ban” weapons; it exempts specified weapons from Second Amendment protections. In other words, her bill strips away Second Amendment protections from applying to weapons not granted a specific exemption in her bill. Here’s the bottom line: Senator Feinstein and her crony co-sponsor Senator Dick Durbin believe Congress has the power to limit Bill-of-Rights guarantees by exempting certain people, places, acts and things from constitutional provisions, such as the inalienable right to own and bear arms. Make no mistake; this legislation is nothing short of a constitutional coup de grace.

Senator Feinstein wails that her bill would permit, mind you PERMIT, 2,271 guns to remain protected by the Second Amendment, so it isn’t a “ban” at all—it is congressional PERMISSION to own certain guns, an indulgence granted by the almighty Congress. This turns the Constitution on its head and makes a mockery of the Bill of Rights.

The Bill of Rights doesn’t PERMIT people anything; it PROHIBITS governments from doing certain things that limit people’s freedom to behave anyway they see fit. It is the Bill of RIGHTS, not the Bill of PRIVILEGES, not a Bill of PERMISSIONS.

Senator Feinstein, are you smarter than a sixth grader? Obviously not, or you wouldn’t say such stupid things about the U.S. Constitution and the Bill of Rights.

___

Stop Reid & Feinstein’s Palace Coup To Overthrow
The Constitution and Bill of Rights

What will be the practical consequences of enacting S. 51 and selectively ignoring the Second Amendment? PRECRIME—a complete reversal of the ancient rights of Englishmen and Americans where the people are guaranteed there will be no detention without charge of a crime; no charge of a crime without probable cause; no conviction of a crime without a trial; no trial without a jury; no conviction without proof beyond a reasonable doubt; no punishment without conviction; no cruel and unusual punishment and no excessive punishment disproportionate to the crime.

The smoking gun that the Feinstein weapons ban bill is the precursor to PRECRIME is that fact that she refused to expand the bill (S.150) to exempt military veterans because they might be “mentally incapacitated.” She would turn “veteran” into a suspect class of likely criminals thus “exempt” from, which is to say make them ineligible for Second-Amendment guarantees. But the “exemptions” from constitutional rights in Queenie Feinstein’s Wonderland don’t stop there.

Consider how under the Patriot Act the government already decides whether any random person might be a terrorist and thus subject to dodgy anti-terrorist PRECRIME actions, which Senator Feinstein’s weapons-ban bill would only exacerbate. The ACLU reports that the law treats a person as a domestic terrorist if they engage in any “act dangerous to human life” that “appears to be intended to (i) to intimidate or coerce a civilian population; (ii) to influence the policy of a government by intimidation or coercion; or (iii) to affect the conduct of a government by mass destruction, assassination or kidnapping.”

As Senator Rand Paul said when the National Defense Authorization Act was passed last year expanding PRECRIME powers for “suspected terrorists,” the government now claims under the color of law the power to “arrest suspects without a warrant, hold them without trial, deny them access to counsel or admission of bail,” and as a result, “We have shorn the Bill of Rights of its sanctity.”

The Feinstein gun-ban bill is another stab in the heart of the Constitution, a mortal blow to the Bill of Rights.

Gun Grabbers on the Move

Four pieces of civilian disarmament legislation made it to the Senate Judiciary Committee Thursday. While Sen. Dianne Feinstein‘s (D-CA) “assault weapons” ban was included in the final package, it faces tough odds of getting anywhere in Congress. Democrats instead chose a piecemeal approach, the reasons being twofold: It increases the likelihood that something gets passed, and if a major overhaul fails, Republicans will face the backlash when Democrats cry wolf.

One of the bills being considered is a bipartisan proposal “that would for the first time create specific federal prohibitions on gun trafficking and the straw purchasing of firearms,” according to the Associated Press. Recall that these were the same tactics used by the ATF in the infamously (and tragically) botched Fast and Furious sting operation. We’re glad to see Congress agrees that the feds shouldn’t be trafficking firearms to Mexico.

In related news, “States with the most gun control laws have the fewest gun-related deaths,” trumpeted the Associated Press this week, citing a study by Dr. Eric Fleegler of Boston and published in JAMA Internal Medicine. However, Fleegler is an anti-gun activist and used data from the Brady Center to Prevent Gun Violence, one of the most anti-gun organizations in the country. Also, though he considered all 50 states, he excluded the District of Columbia. The Brady Center did their own calculations based on findings in a dozen states and came to the conclusion that — surprise — we need more gun control. The inconvenient truth is that the “gun-related deaths” prevented by tougher gun laws are suicides, not homicides. In fact, the homicide rate was slightly higher in the 10 states with the most regulation. DC’s rate is nearly four times that of the rest of the country.

The Brady Center wasn’t the only leftist group promoted by the press either. USA Today placed a piece on an anti-gun study by the Pacific Institute for Research and Evaluation (PIRE) front-and-center of Tuesday’s edition. PIRE’s study purports to show that gun violence cost $12 billion annually. Not surprisingly, financial help is given to the institute through a company tied to none other than far-left billionaire investor George Soros.

Form letter from my State Senator…At least I hear from him in a civil manner. Unlike the State Rep I have representing me.

Thank you for sending your concerns to my office.  As a gun owner myself, I’ve been looking at this issue as it plays out on the Federal level.  I have hunted for years, and as a civics teacher, I am of course a strong supporter of the Constitution and its amendments.

I have no plans to author legislation on gun control, and will only support bills that balance both the need to reduce gun violence with the need to protect the rights of reasonable and responsible gun owners.  I am also concerned about mental health issues as they apply to gun violence in this state.  Identification and prevention of mental health issues are key to reducing gun violence without unduly restricting ownership.

I will take your concerns into account as gun ownership becomes an issue of discussion in the Minnesota Senate.  Again, thank you for voicing your thoughts.  An active constituency is a critical foundation for democracy.

Blame global warming. For everything

Protip: When there’s a problem — any problem — just blame global warming. TheDC’s Jeff Poor reports:

“On Wednesday’s broadcast of MSNBC’s ‘Morning Joe,’ the Center for American Progress’ Christie Hefner said that Chicago’s sky-high murder rate could be blamed — at least in part — on climate change. ‘Yes, last year we hit a record number of murders from guns [in Chicago],’ Hefner, the former chairwoman and chief executive officer of Playboy Enterprises, said. ‘And this year we are already outpacing last year’s numbers. Now, there are contributing factors that are not under anybody’s control and may seem odd, but it is factually true. One of them is actually the weather. There is a dramatic increase in gun violence when it is warmer. And we are having this climate change effect that is driving that.'”

Kids, take note. Why didn’t you do your homework? Global warming, obviously. You failed a test? Sure you didn’t study, but also remember you took it while suffering under global warming. You punched your principal in the face? Everyone knows that’s a predictable consequence of global climate change, duh!

___

Blame Bush! Repeat. Forever

If you get tired of blaming things on global warming and want to mix it up, you can always blame George W. Bush or the GOP. TheDC’s Neil Munro reports:

“White House officials and Democrats are blaming the GOP and Hurricane Sandy for the stunning late-2012 shrinkage in the nation’s economy. … The apparent contraction was announced Wednesday morning when the federal Bureau of Economic Advisers estimated the nation’s gross domestic product nudged down 0.1 in the last three months of 2012. … Brad Woodhouse, the spokesman for the Democratic National Committee, pushed a more explicitly partisan version of the same theme via twitter. ‘GOP holds econ hostage over debt ceiling. Deal to avert crisis includes steep spending cuts they wanted. Economy slows. Blame Obama. #unreal,’ he tweeted at 9.45.”

You may say this doesn’t sound like leadership, but you would be wrong. Remember, in this administration, leadership is defined as leading from behind, which we used to call following. But under this new definition of leadership, Team Obama is a wild success.

___

The youth like the guns

Young Americans are apparently more protective of gun rights than older Americans. Jessica Stanton reports for TheDC:

“A vast majority of young adults under the age of 34 believe that Americans have a right to own an ‘assault weapon,’ according to a new Reason-Rupe poll released Thursday. Seventy percent of 18-24 year-olds and 58 percent of 24-34 year-olds indicated the government ‘should allow the private ownership of assault weapons.’ But a majority of older Americans disagree, with 57 percent of 55-64 year-olds and 61 percent of people over the age of 65 asserting that ‘assault weapons should be prohibited.'”

Surprising.

Harry Reid Prepares to Annihilate Second Amendment

Harry Reid Prepares to
Annihilate Second Amendment

logo

“Our Founders intended the Senate to be a body where legislation was slowed down and subject to improvement through extended debate and amendment. [Harry] Reid’s proposed ‘reforms’ would remove two of the most fundamental rights traditionally reserved to all Senators — to freely debate and amend legislation. I shall not stand for that.” — Senator Rand Paul (R-KY)

On Election Day last November, several Democrat Senators were campaigning for reelection in pro-gun states. And in order to get their constituents’ votes, they promised fealty to the Second Amendment.

Kevin, on November 6, Democrat Senators Joe Manchin (WV), Bob Casey (PA) and Jon Tester (MT) all won their respective elections. These seats, among others, were crucial to helping Harry Reid return to the top post in the Senate.

But only a month after the election returns were tallied, the Senate — under Majority Leader Harry Reid’s control — is now crusading to implement:

* Gun bans on semiautomatic firearms and magazines;

* An effective ban on gun shows;

* A ban on private gun sales, without going through a gun dealer; and,

* Changes in the Senate rules which would allow them to ban guns with a mere 50 Senate votes.

This last proposal is particularly insidious. Gun grabbers are not going to be able to get 60 votes to break a Senate filibuster of gun control. But, with the help of fake “pro-gun” Senate Democrats, they may be able to get 50.

So the question of whether Senate Democrats will need 50 votes or 60 votes will determine whether gun control -– and much of Obama’s agenda -– will be slammed through and passed into law.

This brings us to the “nuclear option.”

This is a trick which anti-gun Democrats intend to use the first day of the Senate session in order to obliterate the Senate rules and clear the way for 50-vote passage of gun control.

Your senator’s vote on the “nuclear option” may be the most important gun-related vote he casts during the 113th Congress. It may be the difference between whether Obama can secure Senate passage of gun bans, magazine bans, gun show bans, and bans on private gun sales.

Anti-gun Democrats will try to tell you that the Senate is just following its precedents.

But that’s a bald-faced lie. As Democrats made clear during the Bush administration when the Republicans were contemplating the “nuclear option,” the nuclear option has been threatened, but the trigger has never been pulled.

Anti-gun Democrats will try to tell you that the “nuclear option” can only be invoked on the first day.

That’s a lie. Senate Rule 5, Paragraph 2, provides that the Senate rules continue from one Congress to the next, unless changed by 67 votes (needed to break a filibuster of rules changes). If the Senate can use brute force to obliterate Rule 5 by 50 votes, it can use brute force to obliterate any rule at any time by 50 votes.

This is a major vote that will have huge ramifications for our republic. Our gun rights are just one of the many freedoms that are on the chopping block right now. And if Harry Reid can squelch his opposition by nuking the filibuster, it will be the first step towards completely obliterating our Constitution.

ACTION: Click here to contact your Senators and tell them that the vote on the “nuclear option” will be the most important gun control vote of the 113th Congress. Urge them to vote AGAINST changing the Senate rules. Tell them to vote AGAINST the “nuclear option.”
