The Obama Administration resumed its assault on gun owners this week, when it unveiled a so-called “Unified Agenda” containing 12 proposed anti-gun regs being planned by the Justice Department.

This prompted a Fox News discussion this week, where GOA Executive Director Larry Pratt debated an anti-gun (Bloomberg) spokesman.  You can view that debate here.

Gun Owners of America will continue to update you about what is happening with this new ground assault being leveled by the Obama administration.

But first, we wanted to alert you to the counter-offensive that House Republicans are waging against Obama’s gun control agenda.

Kudos to Reps. Buck, Gosar, Massie and others

Several Republican Representatives in the House went to bat for gun owners this week and have successfully added good amendments to a “must pass” appropriations bill.

Consider these pro-gun amendments that have been added to the Commerce-Justice-State appropriations bill (H.R. 2578):

(1) Restoration of Rights.  The House of Representatives adopted a GOA-backed amendment on Tuesday, offered by Congressman Ken Buck (R-CO), which would allow persons stripped of their constitutional Second Amendment rights to petition for a restoration of their rights.  Click here to read more.

(2) Blocking Obama ammo bans.  The adoption of three GOA-supported ammo amendments will prohibit the DOJ from banning M855 or 7N6 ammunition ban.  Click here to read more about the Hudson, Massie and Gosar amendments.

(3) Pulling the plug on Operation Choke Point.  The House adopted an important GOA-backed amendment that “defunds” the Choke Point program which the Obama Administration has used to try and squeeze gun companies out of business.  Click here to read more about the Luetkemeyer amendment.

(4) Nixing ATF racism.  Rep. Diane Black’s GOA-supported amendment to prohibit gun forms from asking about the race of the purchaser was adopted by voice vote.  Click here to read more.

(5) Punishing the Department of Justice.  Rep. Gosar successfully added several amendments to cut the budget of the DOJ and the Bureau of Alcohol, Tobacco, Firearms and Explosives.  Click here to read more.

Canadian shooting underscores who the real terrorists are

After murdering an unarmed Canadian soldier on Wednesday, an Islamic terrorist drove to the Canadian Parliament and ran inside.

Armed with a rifle, he intended to commit even more damage, but was thankfully brought down by the Sergeant at Arms.

Anti-gun activists have already pounced on this shooting to call for more stringent gun control laws in Canada. But one author contrasted the Parliament attack with another Canadian terrorist attack using a car:

What about the Muslim terrorist who drove down two Canadian soldiers on Monday, killing one of them?  Does that prove that we need more car control?

That would be liberal logic for you.

GOA report:  Government thinks YOU are a potential terrorist

Sadly, much of this “liberal logic” has infested the Obama administration, which continues to ignore the real threats to freedom and to blame gun owners instead.

After all, what do the above two terror attacks (in Canada) have in common with the recent Oklahoma beheading … the first Ft. Hood shooting … both World Trade Center attacks … the attempted Times Square bombing … the Empire State building shooting … the Boston Marathon bombing … the Arkansas recruiter center slaying … and more?

The answer?  All these attacks were perpetrated by Islamic militants — most of whom were yelling Allahu Akbar while perpetrating their evil deeds.

Which is what makes the Obama Administration’s treatment of gun owners so obviously political.  The administration has ignored the threat from real terrorists, while insisting on calling murderous rampages — such as the one by Major Nidal Hassan at Ft. Hood — “workplace violence,” rather than “terrorism.”

In fact, several reports issued around the country — by the FBI, the Department of Justice, the Department of Homeland Security, and several state governments — all point to conservatives and gun owners as being the real threat to the safety and welfare of Americans.

As stated in a report that GOA recently published:

If you are the kind of person who takes a principled view on gun rights and limited government … has attempted to stock up on firearms, magazines, and ammunition in fear of possible and actual bans … or has ever voted for a third party in a political election … then know this — you had better look over your shoulder, because your government is watching you, and considers you to be a threat.

IRS Targeting is not the only Avenue of Attack

 

As we’ve learned, the IRS under the Obama Administration has been weaponized against conservative non-profits in an effort to stifle opposition speech, but that’s not the only avenue of attack. A partisan bill was introduced in the Minnesota Legislature, but ultimately defeated last year that would impose onerous new regulations on grassroots organizations like Minnesota Majority, Tea Party groups and numerous other non-profits

It’s back this year and it contains all manner of vague, subjective language (like “clearly;” “reasonable;” and “biased,” that will allow a small 6-member board, appointed by the governor to determine who has violated the proposed new campaign finance laws and who has not. “Bias” is often in the eye of the beholder. In this case, it’s up to the governor to determine who the “beholders” are.

HF1944/SF1915 proposes to create “free speech zones” on the calendar, allowing the state to determine when grassroots groups can engage in unfettered speech and when such speech would be regulated.

Last year, Governor Dayton pledged not to sign any elections bill that didn’t have “strong bipartisan support” and legislators mostly seemed to respect that, but this year, it looks like Democrat leaders want to test the waters and pass bills that will alter our election laws on a purely partisan basis in hopes that the governor will break his pledge and sign them into law.

Obama Proposes Massive Gun Ban by Regulation Fiat

GOA prepares legislation to block implementation

In a “Friday media dump” designed to conceal its actions by releasing them after the press has left town, the Obama administration last week announced its intention to push two regulations which would massively expand the federal gun bans imposed on Americans.

“SEE A SHRINK; LOSE YOUR GUNS”

The first proposal — from HHS — would effectively say that federal health privacy laws (HIPAA) do not apply to the Second Amendment.

This isn’t the first time Obama has stuck his leering eyeballs into Americans’ medical records and private affairs.  From its Orwellian government database on Americans’ health records to its voracious seizure of Americans’ phone records, the Obama administration can’t trample our personal privacy fast enough.

But HHS Secretary Kathleen Sebelius’ efforts to turn over personal mental health information to the government’s gun ban blacklist (NICS) is particularly loathsome.

Not to be outdone in the Sebelius/Holder “Mutt and Jeff act,” Attorney General Eric Holder — currently being pursued for contempt of Congress — intends to seize guns from persons subject to “outpatient commitments (even without a court order) (and) … someone (deemed by some bureaucrat to be) lacking mental responsibility or deemed insane…”

More than 150,000 law-abiding veterans have already lost their constitutional rights — with no due process whatsoever — because they consulted a VA therapist about a traumatic incident in Iraq, Afghanistan, or the Balkans.

Under these new regulations, tens of millions of police and firemen with Post Traumatic Stress Disorder — or people who, as kids, were diagnosed with Attention Deficit and Hyperactivity Disorder — could lose their constitutional rights without any court order, merely because they sought a benefit under a federal program.

And you want to know the hidden agenda behind DOJ’s “commitment” language?  We have a member in a rabidly anti-gun state.  Many years ago, he was picked up by police and, without the approval of any court, sent to a mental facility overnight for “observation.”  The mental facility found no mental problems and promptly released him.

However, many years later, as a result of that state’s anti-gun crackdown (which Holder is now trying to emulate), his name has been sent to the NICS system.  He has lost his constitutional rights, and it will cost him tens of thousands of dollars (which he does not have) to get them back.

We believe this is unlawful under current law.  But it will probably not be unlawful by the end of Holder’s regulatory proceedings.

What does Sebelius have to say about this?  Well, she is surprisingly flip:  “There is a strong public safety need for this information to be accessible to the NICS, and some states are currently under-reporting or not reporting certain information to the NICS at all.”

And this from the White House:  “…when persons with a mental illness do not receive the treatment they need, the result can be tragedies such as homicide or suicide.”

But herein lies the problem:  When Americans with Post Traumatic Stress Disorder and Attention Deficit Disorder realize that nothing they say to their therapist is really confidential, they’re not going to be seeking treatment for very long.

But there’s an even more fundamental problem:  Last winter, Barack Obama decided that he would devote the first half of 2013 to the destruction of what he and his supporters characterized as “the gun manufacturers’ lobby.”  Tens of millions of Americans let their senators and representatives know that they found Obama’s views and Obama’s legislation to be odious and offensive.  As a result, it was rejected in the Democrat-controlled Senate.

So now, as has happened so many times before, Obama has set himself “above the law.”  What could not be done using constitutional processes is now being slammed through by regulatory fiat.

The Justice Department and HHS regulations will now be submitted for “public comment and review.”  But, as with everything else Holder and Sebelius do, this is little more than a sham.

Rather, our efforts will be to get Congress to defund these unconstitutional efforts.  And we will start by submitting proposed legislation to friendly senators and representatives.
